Terms of Service

Effective April 2026

Please read these Terms of Service carefully before using the We Are Resilient™ app or the Dovetail Learning website. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the We Are Resilient™ mobile application and the Dovetail Learning website (collectively, the “Services”), operated by Dovetail Learning, a nonprofit organization located at 16110 Coleman Valley Rd., Occidental, CA 95465.

By creating an account or using any part of the Services, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Description of Services

We Are Resilient™ is a wellness application designed to help individuals build resilience skills through mood check-ins, micro-courses, guided reflections, breathing exercises, a structured resilience pathway, and goal tracking. The app is intended for personal, non-commercial use.

Some features are available for free. Full access to the Resilience Pathway, all micro-courses, and additional features requires a paid premium subscription.

3. Accounts and Registration

To use the app, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not create an account on behalf of another person without their permission. Dovetail Learning reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription Services and In-App Purchases

Premium Subscription

We Are Resilient™ offers auto-renewable premium subscriptions that unlock the full 12-week Resilience Pathway, all micro-courses, and newly added features. The following terms apply to all subscriptions purchased through Apple’s App Store:

  • Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription period: Subscriptions are available on a monthly or annual basis. The length and price of the subscription are displayed at the time of purchase.
  • Auto-renewal: Your subscription automatically renews at the end of each period unless you turn off auto-renewal at least 24 hours before the current period ends.
  • Renewal charge: Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
  • Cancellation: You may cancel auto-renewal at any time by going to Settings → [Your Name] → Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period; you retain access to premium features until that date.
  • No mid-period cancellation: Active subscription periods cannot be refunded once charged.
  • Free trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.
  • Refunds: All billing is managed by Apple. For refund requests, please contact Apple Support directly.

Restoring Purchases

If you have previously purchased a subscription, you can restore your access on a new device using the “Restore Purchases” option in the app.

Price Changes

We reserve the right to adjust subscription pricing. If pricing changes, you will be notified in advance and will have the opportunity to cancel before the new rate takes effect.

5. Free Content

Certain features of the We Are Resilient™ app are available at no cost, including mood check-ins, a limited portion of the Resilience Pathway (Week 1), selected micro-courses, journal and reflection tools, breathing exercises, goal tracking, and the resilience assessment. Free features may change over time.

6. User Content

The app allows you to enter personal content such as journal reflections, mood check-ins, gratitude entries, and goal data (“User Content”). You retain ownership of your User Content. By entering it into the app, you grant Dovetail Learning a limited license to store and display it solely for the purpose of providing the Services to you.

You are responsible for the content you enter. You agree not to enter content that is unlawful, harmful, abusive, or violates the rights of others.

7. Intellectual Property

All content within the We Are Resilient™ app and on the Dovetail Learning website — including the We Are Resilient™ framework, curriculum content, skill descriptions, course materials, text, graphics, and software — is the property of Dovetail Learning and is protected by U.S. and international copyright and trademark law.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of our Services without our prior written consent.

8. Health and Wellness Disclaimer

The We Are Resilient™ app is a wellness and educational tool. It is not a substitute for professional mental health treatment, therapy, or medical advice. The content and exercises in the app are designed to support resilience-building and general wellbeing.

If you are experiencing a mental health crisis or emergency, please contact a qualified mental health professional or call 988 (Suicide & Crisis Lifeline) immediately. Dovetail Learning does not provide clinical care and is not responsible for outcomes related to your use of the app.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. Dovetail Learning does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Dovetail Learning shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the six months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of Sonoma County, California.
